I'm thinking about trading my 2004 rear wheel drive 3 series in for a 2013 3.6r.
I have read about a steering problem on the Legacy. Has the problem been solved?

If it's the shimmy you are asking about, then I would say yes. There have been little to no info from 2012s.

Even better, the 2013s have made many additional suspension changes (e.g. spring rates, shock dampening rates, improved bushings, beefier strut mounts) to improve on-road performance and eliminate sway.

I never had a steering issue in my 3.6 and I've had it since 04/10 23k miles.

No steering problems with my 2011 3.6R with 18k miles that I have had since July 2011.

I had the shimmy issue, but subaru fixed it with their tsb. I never felt like there was an issue with steering. I am a little jealous of the suspension upgrades for the 2013s.
