What are my rights

I bought a 2005 Legacy 2.5 GT in december. Today, I start it and it begins to shake violently. I take my moms car and she takes it to the dealer. They say that warranty should cover it.The warranty expired in September 07, but we bought the car in december with the paper in the window saying it still had a warranty on it. I took it to an import mechanic and he said that one of the cylinders is not firing, or something. They said that I still had a warranty, but now they say it expired. I feel that I am entitled to the warranty because they got the car after the warranty expired(A lease return) and put it back with the warranty paper on it.

 

Help???

more details, how many miles are on your car, did you buy it from a Subaru dealer, what warranty expired? there are multiple warranties

 

Did you get a copy of anything in writing on the bill of sale??

 

If you don't have anything in writing you should take them to task about warranty coverage. Think it may be a tough battle and they may try to claim you are mistaken and there is no coverage now or when you purchased.

2005 should still be under the 5yr/60k powertrain warranty...unless it's over 60k miles, but that only covers a limited number of drivetrain components...what did the dealer say was wrong after they looked at it? What is the car's maintenance history? Mods?

It has 31000 ish miles

It was bought from a subaru dealer

The dealer didn't look at it, an import specialist did.

 

My parents were pretty pissed off because it 60 dollars to fill my tank a few days ago, and are getting a little uneasy due to this hiccup

 

I am a total rookie, but are the cylinders part of the drive train?

The drivetrain usually consists of the engine and transmission, along with the differentials and drive shafts (everything needed to move the car, from the engine to the wheels), so the cylinders are covered by a drivetrain warranty.

Also check your local regulations regarding purchase of used cars.

 

Where I live the dealer has to give a 3 month guarantee even if the car's original guarantee has expired unless it's older than a certain number of years (I think it's 10) then it's a 1 month.

 

But failures always happens after the guarantee has expired...

There are two warranty's actually more that cover the car. The likely one that expired was your 3yr/36k bumper to bumper one. If your under 5yr/60k then the powertrain warranty will likely cover it.

 

Take it to the dealer for a diagnosis at the very least and sounds like coverage of problem unless electrical.

If it's a spark plug or coil problem, neither of those components are covered under the 5yr/60k powertrain warranty. Is the car showing a check engine light? If so what is the code?

just ask the dealer you bought it from ... I would go there and complain my ass off.

 

Even if its not covered by warrenty they'll most likely cut you a deal.

 

If you have the bill of sale and it says it covered under warrenty I'm pretty sure that they are required to respect that even if it may be a misatake.

Take it to the dealer and get the diagnosis from them at least. After the diagnosis see what the dealer will do, then go from there. Sounds like a simple problem, just for piece of mind I hope you have checked the oil level since you purchased the car if you haven't you should.

So, I took it to that specialist, and my dad, who thinks he knows a lot about cars, asked him to put some very high octane gas in(I am not sure how high, but I think it was around 100-10) and the shaking stopped. It is being checked out by the dealer right now, though.

I was under the impression that a bill of sale was a legal document, or practically so, at least in some states. I thought that was kinda the point of it...to avoid dealer talk so you would know exactly what you are getting.
