Ok I'll play. If the damage was caused by road hazard, then how is that a design flaw. Secondly if it happened while on the road an it was an accident then it may be considered an insurance claim...

Also keep in mind that the car needs to learn your driving style. My '12 felt slower than my '07 until I broke it in. Now it is as fast as my '07. It is not GT fast, but it is adequate and fun.
